As with all POA’s, you (the Principal) authorize someone else (your Agent) to act for you. In this real estate POA, the home owner is appointing someone else to sign in their place on the sale of a home, or any real property located in Louisiana for that matter. This can be used for the purchase or sale of property. There is also a specific POA for the mortgaging of property.
For example, let’s say that John Doe owns a home. John is going out of town, so he will not be present at the closing for the sale of his home. John may appoint Sara Doe to represent him at the closing. Sara will then sign the closing documents in John’s place. With the twist of a few words, this form can also be used for John to purchase a home, appointing Sara to represent him in that matter.
For the Louisiana Mortgage Power of Attorney, let’s say that John has his home mortgaged with XYZ Mortgage Company for 7%. John has a better deal set up with VHJ Mortgage company for a rate of 3%. The problem is that John will be out of town during the closing. John can appoint Sara, once again, to represent him at the mortgage closing.
